When we meet with clients regarding their estate plans, we always discuss Power of Attorneys, and our position is that no estate plan is complete without Power of Attorneys.

That being said, we’ve found that there are many misunderstandings regarding Power of Attorneys, how they work, and when they work.

This post will discuss the commons myths we hear about Power of Attorneys.

  1. You can use a Power of Attorney form the internet.
    While there are various types of Power of Attorney forms available on the internet, one has to remember that they are granting someone an extensive number of rights to act on their behalf. You want to ensure that you are doing so properly.
  2. A Power of Attorney is effective after one’s passing.
    It’s important to understand that a Power of Attorney is only effective during one’s lifetime. Once the person has passed away, the Power of Attorney is no longer effective, and one’s will or trust comes into effect to control the disposition of one’s assets.
  3. A person doesn’t need to have a Power of Attorney until they need one.
    Unfortunately, we’ve had clients want to sign a Power of Attorney, but we are unable to do so because they don’t have the competency to do so. It’s important for one to have their Power of Attorney in place before they need it. After one has lost competency, the only option at that time would be to open a guardianship proceeding through the courts.
